What is Smfyoo?
Smfyoo is a webpage with a team including 7 very qualified designers, coders and project managers. Smfyoo intends to design and code free and premium simple machines forum themes. We work with very talented deviantart designer sencerbugrahan. The team also has other members who have graphic design skills. Once graphics are designed, our theme coders code the themes. Our themes are planned to be tableless design with semantic mark up. They are released under the GPL version 2.0 licenses (http://www.gnu.org/licenses/gpl-2.0.html GNU/GPLv2). As such the PHP code portions of these themes are distributed under the GPL version 2.0 licenses. If not otherwise stated, all images, cascading style sheets, and included JavaScript are NOT GPL, and are released under the Smfyoo Proprietary Use License unless specifically authorized by Smfyoo. Elements of the smfyoo themes released under this proprietary license may not be redistributed or repackaged for use other than those allowed by the Terms of Service of the yooclub. Please review the Terms of Service for further information on these usages. Theme images, cascading style sheets and JavaScript elements are copyright Smfyoo and can be used and manipulated for your own or your clients purposes. You cannot redistribute these files as your own, or include them in a package or extension of your own without prior consent of Smfyoo. The use of these portions and our premium themes are bound to the number of entitlements yooclub membership provides as well as the restrictions on distribution that the Terms of Service outline.

1	How do you join a club? Joining is easy, just select the club that's right for your needs.
2	Which club is the best deal? We have 4 types of memberships. Please see entitlement questions and answers to decide which club suits for you. We have short term and long term deals. It depends on your choice.
3	How many premium themes can I use during my membership? During your membership, you can download and use every theme which had been released before your membership due. However, you are limited to use our premium themes depending on our entitlement policy. You can use our themes for your 10 webpages at most if you are a platinum member. Hence, please see our entitlements policy for your entitlement questions.
4	Can I purchase just one theme? We believe the club model that smfyoo uses is the best solution for our users. We provide short term memberships with single entitlements that enable all themes usage for a small fee. But we also provide longer term memberships that allow our users to change their minds, and get new themes, as well as providing more entitlements.
5	Can I download theme available during my membership when my membership has expired? No, membership entitles you access to the downloads and club-only areas of the forum. When your membership expires, you no longer have access to these club benefits and you must renew to regain access.
6	Do you provide source files, if so, in what format? Yes, we provide source files in the Adobe Photoshop format. Therefore, you will need to have Adobe Photoshop in order for you to make full use of our source files.
7	Is there a download limit? Downloads are unlimited for the duration of your membership, meaning you can download all the templates, extensions, sources and other packages as many times as you like, at any point during your subscription. Note that downloads are unaffected by your entitlements count. Downloads are restricted after your membership expires.
8	Can I renew a membership if my account is already active? You can renew your membership within 30 days of it's expiration. If your membership does not expire for more than 30 days, you may be able to purchase entitlements only which allows you more usages, but does not extend your expiration date.
9	What is an entitlement? Entitlements refer to the number of instances (sites) that can use our themes. 1 entitlement is required for every live instant of a theme or extension. Therefore, if you had 3 websites using our themes, you would need 3 entitlements. 10	Can I share or sell my account? No, smfyoo yooclub accounts are non-transferable per the Terms of Service.

Entitlement Questions

1	What is an entitlement? Entitlements refer to the number of instances (sites) that can use our themes. 1 entitlement is required for every live instance of a theme or extension. Once you register a yooclub, you are asked to write your webpage name to use our themes. All webpage names are recorded in our databases and checked regularly. In fact, we have a call back function in our themes so that our premium themes can only downloaded and used by our yooclub members.
2	Can I use every released theme for my entitlements. Yes, you can use every theme, free or premium themes. You can use all premium themes released before your yooclub membership expiration for your webpages listed in the entitlements.
3	How do I register my entitlements? During the registration process, your entitlements are asked. Once you write your webpage name in the entitlements section, you cannot change it. Hence, we recommend you to be careful during the registration process. If you write your webpage name incorrectly, we can correct only typos. We don’t accept to change your entitlement with a new webpage name.
4	Can I use unlimited entitlements, or do you have an unlimited entitlement option? No. We provide our customers joining 4 type of yooclub during the registration. Once or before your registration expires, you upgrade to upper level clubmembership. To see our membership levels and its benefits, please see yooclub questions.
5	Can I use entitlements about membership expiration? No. You have to write your entitlements during the registration. Hence, we recommend you to decide about which club membership is right for you before your registration. If you want to add another entitlement, you can register again for another one, or more by upgrading to upper levels. If you make typos during the registration, or forget to right your entitlements, you should inform us in a week to correct your entitlements.
6	If my account expires, do I lose my entitlements? No. You can use your downloaded themes for your webpage entitled forever. However, you cannot download more themes after your club membership expires.
7	If my account expires and I renew later, do I still have both my old and entitlements? Yes, entitlements are cumulative. When you renew, and/or purchase additional entitlements, they will be added together. Therefore, if you started out with 10 entitlements from a Platinum Member Yoo Club membership, then renewed for another year, you would have 20 entitlements in total.
8	When do my entitlements expire? Entitlements are not restricted to the duration of your membership; a site setup using an smfyoo theme can continue to use it, even after expiration.
9	How do I purchase more entitlements? You can purchase entitlements from the Join a Club page. If you within 30 days of your account expiration, you can renew your membership and be granted extra entitlements, in addition to the extended term

About Yooclub

Our Simple Machines Forum themes are based on existing Curve theme with tableless semantic designs. We design at least one premium theme every month, and these themes provide a stunningly unique forum design to enable you to stand out from the crowd. Our extensive community forums allow you to quickly get help and learn how to bring your own ideas to life. We offer a variety of subscription options to satisfy the needs of any individual, organization or business. Our steadily growing portfolio of styles allow you to quickly and easily transform your smf forum into a professional quality site that well set you apart from your competition. Once you become a club member, you can get support for our themes to report any problem, or to request a modification help. We will do our best so that you can use our themes with valid compatible modifications.
Yooclub offers 4 type of membership. You can upgrade to upper levels without losing your entitlements. Please see entitlement questions to understand our entitlement policy.

Copper Membership
Copper members will be able to download our themes released before their expiration of memberships for 30 days. They can also get support during their membership. Copper Membership owns one entitlement. That means, during the registration of copper membership, member can set one webpage name to use our premium themes. Membership requires $30 payment, and we accept any credit card or bank account payment via paypal’s secure payment system.
Silver Membership
Silver members will be able to download our themes released before their expiration of memberships for 90 days. They can also get support during their membership. Silver Membership owns two entitlements. That means, during the registration of Silver membership, member can set two webpage names to use our premium themes. Membership requires $50 payment, and we accept any credit card or bank account payment via paypal’s secure payment system.
Gold Membership
Gold members will be able to download our themes released before their expiration of memberships for 90 days. They can also get support during their membership. Gold Membership owns five entitlements. That means, during the registration of Gold membership, member can set five webpage names to use our premium themes. Membership requires $75 payment, and we accept any credit card or bank account payment via paypal’s secure payment system.
Platinum Membership
Platinum members will be able to download our themes released before their expiration of memberships for 90 days. They can also get support during their membership. Platinum Membership owns ten entitlements. That means, during the registration of Platinum membership, member can set ten webpage names to use our premium themes. Membership requires $125 payment, and we accept any credit card or bank account payment via paypal’s secure payment system.

Terms of Service
Smfyoo hereby grants you a revocable, non-transferable and non-exclusive license to use the web extensions and other products sold through our web site by Smfyoo (the “products”) in accordance with these Terms of Service (the “license”) issued by Smfyoo.
NOTE: The term Extensions, Templates, Themes, and Styles may be used interchangeably in the terms below:

1	Limited Usage Granted:
	You have the right to use the Smfyoo themes on as many concurrent sites as your entitlements provide for. After your membership expires, you may continue to use the themes your entitlements allow for, so the themes are not time-limited.
2	License:
	Smfyoo extensions are GPL compliant. All PHP portions of the extensions are licensed under the appropriate GPL license of the parent platform. The non-compiled portions including images, cascading style sheets and JavaScript of "Club" extensions are licensed under the The "Smfyoo Proprietary Use License" in accordance with the rest of these Terms of Service. "Free" extensions are released with all aspects of the extensions released under either GPL and/or MIT licenses. Further details on the licenses can be found in the Smfyoo Licenses link at the bottom of every page on smfyoo.com
3	Modifications:
	You are authorized to make any necessary modification(s) to our products to fit your purposes. You may not however redistribute or release modifications as GPL or otherwise. You must also not change or remove the copyright information in the header of the xml descriptor file. You may not remove our copyright from the footer of the theme. No use of our trademarks is granted under this Agreement. Please read the FAQ section regarding this if you have further questions. Porting to other platforms and content management systems and redistributing as GPL or otherwise is also strictly prohibited. Please contact us if you have any requirements that are not covered by these terms.
4	Unauthorized use:
	You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from Smfyoo. Please contact us if you require more clarification.
5	Updates:
	All themes are always designed for the latest version of the simple machines forum they are designed for, but we can give no guarantee that the themes will run with previous versions of smf. Members may use the forums to address any issues related to software versions.
6	Delivery:
	After we have successfully received your payment, your Smfyoo membership information will be emailed to the email address you provided. This may take up to 1 hour but usually happens within minutes. If you do not receive an email after this time period, contact us through this website. Upon logging in with the provided credentials, Smfyoo members will have instant access to all themes and club forum. During the membership term, full access will be provided to the themes and the forums. After membership has expired, download access is removed, and forum access is limited, entitlement rights continue however.
7	Assignability:
	You may not sub-license, assign, or transfer this license or Smfyoo club subscription to anyone else without prior written consent from Smfyoo
8	Ownership:
	You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are the property of Smfyoo. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall Smfyoo be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
9	Use of Content:
	You acknowledge that the site contains or may contain material (collectively the “Content”) which is protected by copyright, trademark or other proprietary rights; therefore, you are only permitted to use the material as expressly authorized by Smfyoo. You may not transfer or sell, reproduce, create derivative works from, distribute, or in any way exploit any of the Content, in whole or in part, except with an expressly permitted Agreement from the developer.
10	Refund policy:
	Since Smfyoo is offering non-tangible goods we do not issue refunds after the membership is made, which you are responsible for understanding upon registering at our site.
11	Warranty:
	Smfyoo expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of title, merchantability including, but not limited to merchantability of computer programs, and fitness for a particular purpose. Smfyoo does not warrant or guarantee these extensions in any manner. We cannot guarantee they will function with all 3rd party extensions as there is currently no certification process for such components. Browser compatibility should be tested against the demonstration extensions on the demo server. Please ensure that the browsers you use will work with the themes as we can not guarantee that Smfyoo themes will work with all browser combinations. Some states or jurisdictions do not allow the exclusion of certain warranties. Nothing in this section should be construed as excluding or limiting any warranty beyond what is permissible under applicable law.
12	Support:
	Smfyoo offers these themes and designs ‘as is’, with no implied meaning that they will function exactly as you wish or with all 3rd party components and modules. Further, we offer no support via email or otherwise for installation, customization, administration, etc. A private members-only forum is available to YooClub members. Smfyoo does not commit to monitor these forums, but we reserve the right to respond and answer questions. You acknowledge by your use of the themes that it is at your sole risk, and that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with the themes.
13	Referrals and Links:
	Smfyoo rejects any responsibility concerning any contents linked or referred to from his pages - only if he has full knowledge of illegal contents and therefore would be able to prevent the visitors of his site from viewing those pages. Only the author of these pages should be hold liable for any damages which might occur out of this. The author also rejects any responsibility concerning any postings or messages which are published by users of discussions boards, guestbooks or mailing lists provided on this page.
14	You agree to indemnify and hold Smfyoo harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the themes or this website.
15	Smfyoo reserves the right to change the Terms of Service from time to time. Further, Smfyoo reserves the right to modify or discontinue any portion of the membership. Smfyoo shall not be liable to you or any third party should Smfyoo exercise its right to modify, suspend, limit or discontinue any feature of the membership
16	Use of the themes and this website shall be governed by and construed in accordance with the internal laws of the State of Pennsylvania. You agree to submit to the non-exclusive jurisdiction of any United States Federal or Pennsylvania State Court sitting in Allegheny County, Pittsburgh in any action or proceeding arising out of or relating to the use of this website or extensions.
17	If any provision of the Terms of Service are held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
